On the 20th of July 1616, the sheriff and aldermen of this city, upon the written request made by or on behalf of Eduwaert Butcher and Jan Sissel, both merchants in England, have hereupon authorised the first officer with the rod, as requested herein, to place and take into arrest the persons of Johan and Willem Crips within this city and its freedom, in order to recover thereby, respectively, their outstanding debts by virtue of the bonds concerning the same, but all this at the risk of the aforesaid petitioners.

In the margin: Judgment book T, folio 296 verso. Heemskerck, time of fourteen days on account of the defendant's absence. Schilperoort: let it be granted for eight [days]. Done 4 November 1616.

The aldermen find a first default, having regard to the declinatory plea, and condemn [the defendant] to three stuivers; they grant a second citation. Done 23 December 1616.

The aldermen find a second default, having regard to the declinatory plea, and condemn [the defendant] to three stuivers; they grant a third citation. Done 23 January 1617.

The party on behalf of the defendant, purging the defaults, requests a copy of the obligation and a day [to answer]. Schilperoort: let it be granted. Done 30 January 1617.

The party requests time until [the next session]. Schilperoort: let it be granted, upon the default. Done 13 February 1617.

The party on behalf of the defendant is content to pay the debt demanded, provided that forty-two like pounds sterling be deducted for white stockings delivered, and that he be given a term of two half-years for the remainder. Schilperoort demands condemnation for the whole sum, denying that any such deduction is due, and maintains that no term of payment ought to be allowed.

The aldermen, having heard the parties and considered everything that might move them to do justice, condemn the defendant to pay the sum demanded, denying that any deduction is due, together with the costs at their assessment; and provided he furnishes surety subject to this city's court, they suspend execution for a period of twice three months, each time to pay one half. Today, the 13th of March 1617, there appeared before me, notary public, and before the undersigned witnesses, Joris Blexten, resident of this city, who hereby set himself up and constituted himself as surety and guarantor, renouncing the benefit of order (beneficium ordinis), for Bartholomeus Smit, in order to pay to Jan Crip, Englishman, such sum of thirty-five guilders as the aforesaid Smit was recently condemned to pay, by the Lords Peacemakers (vredemaeckers) of this city, to the benefit of the aforesaid Jan Crip, with one half payable on the coming May Day and the other half on the following St. James's Day.

The appearer accordingly promised to satisfy and pay the aforesaid condemnation himself at the aforesaid terms, under obligation of his person and goods, subjecting the same for that purpose to the execution of all the lord's rights and courts.

The aforesaid Bartholomeus Smit, likewise appearing before us, notary and witnesses, in turn promised to hold the aforesaid Joris Blexten free of cost and harmless on account of this his suretyship, under like obligation and constraint as above; and the appearers further requested an instrument of this.

Thus done within the city of Leiden, at the house of me, the notary, on the aforesaid day and year, in the presence of Cornelis Joppenszoon, wine merchant, and Abraham Ente, pastry baker, residents of the aforesaid city, as witnesses requested hereto. There appeared before me, notary public, and the undersigned witnesses, Artus Stanten, aged about 42 years, and Niclaes Claverly, aged about 27 years, both tobacco-pipe makers, residing within the city of Leiden.

And they have, at the request and instance of Digores Prest, hatter, likewise residing within the aforesaid city, upon their respective consciences and the salvation of their souls, in place of an oath, testified and declared to be true that they, on Saturday the 17th of this current month of June, toward evening, were at the dwelling and with the person of Jan Crips, Englishman, card-maker, residing on the Breestraat within Leiden, and then heard the same say and acknowledge that the requester had not struck him, Jan Crips, but had only touched his ruff.

Declaring nothing further, the witnesses offering, should it be necessary and should they be required in case of recollement, to confirm the aforesaid further by solemn oaths. Consenting that one or more public instruments be drawn up and issued hereof by me, the notary, in form.

Thus done within Leiden at the office of me, the notary, on the twenty-ninth of June in the year sixteen hundred seventeen, in the presence of Pieter Joostensz. Warmont and Cornelis Gerytsz. de Haes, clerks, as witnesses hereto required together with me, the notary.

Today, the 30th of June in the year 1617, there appeared before me, notary public, and the undersigned witnesses, Niclaes Claverly, tobacco-pipe maker, aged about 27 years, and Claes Omaer de Wymile, mason, aged about 28 years, both residing within the city of Leiden.

And they, at the request and instance of Digores Prest, hatter, likewise residing within the aforesaid city, testified and declared upon their respective consciences and the salvation of their souls, in place of an oath, to be true: that Jan Crips, Englishman, wool-card maker, likewise residing within the city of Leiden, who has a wedded wife and children living, is of ill repute and reputed to be having and keeping dishonest dealings with Lijsbeth, the wife of Jan Mos, wool comber, likewise residing within the aforesaid city.

And that the deponents, about a month ago, themselves heard the aforesaid Jan Crips say and admit, at the house of the aforesaid Claes Omaer de Wymile, that he ate of the bread of the aforesaid Jan Mos as often as he pleased; which the aforesaid Jan Crips, apparently wishing afterward to make his meaning clearer, added, in express words in the hearing of the deponents, that he slept with the wife of the aforesaid Jan Mos and had his way with her as often as he wished, saying moreover that he would even dare declare under oath that the wife of the aforesaid Jan Mos belonged to him, Jan Crips, and to her husband, but to no one else.

To my worshipful lords, the lords of the magistracy of the city of Leiden.

With due respect, Jan Henricxzoon van Buric shows that he, the petitioner, in accordance with the writ of arrest hereto attached, has had certain goods, as described in the said writ, seized by Pieter Janszoon van Outshoorn, Your Worships' officer with the rod, the said goods having been found in the petitioner's house and belonging to one Jan Crips, Englishman, who is presently in hiding and a fugitive, in order to recover therefrom the petitioner's outstanding house-rent, since the aforesaid Jan Crips remains in hiding as stated.

He, the petitioner, therefore turns to Your Worships, requesting and praying that You be pleased to authorise and commission the aforesaid officer to sell the goods described in the said writ of arrest for the benefit of the creditors of the aforesaid Jan Crips. This done, etcetera.

In the margin stood, by way of endorsement, that the magistracy of the city of Leiden has resolved that Pieter Janszoon van Outshoorn, officer with the rod, may proceed to sell the seized goods publicly, as is customary, and that the proceeds thereof shall be brought to the city's registry, to be disposed of by the aldermen as is proper.
