Today, the fifth of November in the year sixteen hundred and twenty, there appeared before me, Adriaen Paets, notary public, admitted by the Court of Holland upon the nomination of those of the magistracy of this city of Leiden, together with, before the witnesses named hereafter, Jan Kebel, serge dealer, about 38 years old, and Andries Charp, tobacco pipe maker, about 40 years old, both of the English nation, living within this city; and they have, upon their respective true word, conscience and salvation of their souls, in place of an oath, at the request and instance of Hendrick Baeyfoort, likewise a tobacco pipe maker and of the English nation, testified and declared to be true that they, the deponents, were some days ago requested by the requester to act as good men [mediators] over the making of a settlement between the requester and Pieter Mariaes, camlet worker, likewise living within this city, on account of the wound which the latter had inflicted upon the requester, and that they accordingly, on Tuesday last past, together with the requester, met at a certain inn on the Achtergraft near the Doelen, where at the same time the aforesaid Pieter Mariaes also came, having with him likewise two good men.

The deponents further declared that on that same day, concerning the making of the aforesaid settlement between the aforementioned persons, various proposals were put forward and used on both sides, and that the requester demanded, for his lost time and painful suffering, eighteen guilders, in addition to the surgeon's fee for the wound, which he likewise understood was to be paid by the aforesaid Mariaes without further ado; whereupon the said Mariaes, being heard, indeed admitted that he had wounded the requester in his hand with a certain piece of iron, with which he had struck him in his house, adding thereto, on being asked why he had so wounded the requester, that he had done so out of great haste and anger, and because the requester, when he had asked him how he had come by the reel-yarn that had been at his house, had answered that he did not wish to have anything to do with it, adding that if he had anything to say he should take him to law, and that he had also ordered him out of his house, without his having had any other cause for the aforesaid; and thereupon the said Mariaes, through his good men, offered on behalf of the requester thirty stivers for his pain, suffering and lost time, and that he would in addition pay the surgeon's fee, but would go no higher; with which the requester, not being content, the settlement between the aforesaid parties failed to be reached, and they parted at the said time from one another without the parties being reconciled; the deponents giving as their reason for knowledge that they had heard and seen the aforesaid on the said day, and had been present at and witness to the occurrence thereof.

Declaring nothing further, the deponents offering, should it be necessary and if requested, to confirm the foregoing more fully under solemn oath, and the requester requested that an instrument in due form hereof be drawn up by me the notary and delivered to him.

Thus done, executed and passed on the day, month and year aforesaid, at the office of me the notary, in the presence of Cornelis Cuylman and Dirck van Hallmael, clerk, residents of this city, as trustworthy witnesses, signed hereto together with me the notary. Hiervan acte in forma uytgegeven Op huyden den vijffden november anno XVIc ende twintich compareerden voor mij Adriaen Paets notaris publycq bij den Hove van Hollant opte nominatie van die van de gerechte deser stadt Leyden geadmitteert, mitsgaders voor den getuygen naergenompt, Jan Kebel saytrapier out omtrent XXXVIII jaeren ende Andries Charp toebacpijpmaecker out omtrent XL jaeren beyde van de Engelsche natie wonende binnen deser stede, ende hebben bij haerluyder respective manne waerheyt conscientie ende zielen salicheyt in plaetse van eede ter requisitie ende instantie van Hendrick Baeyfoort mede toebackpijpmaecker ende van de Engelsche natie, getuycht ende verclaert warachtich te wesen, dat zij deposanten eenige dagen voorleden bij den requirant versocht zijn geworden om als goede manier te staen over ‘t maecken van de accordatie tusschen den requirant ende Pieter Mariaes greynwercker mede wonende binnen deser stede, van wegen de quetsure die dezelve den requirant hadde geinstigeert, ende dat zij dienvolgens op dynsdage lest voorleden beneffens den requirant hen hebben laten vinden in zeeckere herreberge opte achtergraft bij de Doelen, alwaer ten zelven tijde mede quaemen d’voorseyde Pieter Mariaes bij hem hebbende, oock twee goede mannen. Verclaerden voorts zij deposanten, dat ten zelven dage nopende ‘t maecken van de voorseyde accordatie tusschen de voorgeroerde personen ten wederzijden propoosten vielen ende gebruyct werden, ende dat den requirant eyschte voor zijn versuymde tijt pijnende smerte achtien guldens, ende dat boven ‘t meesterloon van de quetsure ‘t welc hij mede verstont dat bij de voorseyde Mariaes sonder moeten werden betaelt, waer op d’zelve Mariaes gehoort zijnde bekende d’zelve wel dat hij den requirant gequetst hadde aen zijn hant mit zeecker stuc van een ijser, daer mede hij d’selve in zijn huys hadde gesmeten vougende daerbij opte affvraging hem gedaen waeromme hij den requirant zoe gequetst hadde, dat hij dat uyt groote haesticheyt ende toorn hadde gedaen ende om dat de requirant, ten tijde hij d’zelve vraechde hoe hij aen de haspelgaern die t’zijnen huyse was geweest gecomen was daerop geantwoort hadde, dat hij daermede niet wilde te doen hebben mit bijvouging zoe hij wat hadde te zeggen dat hij hem mit recht soude aenspreecken ende dat hij hem oock uyt zijn huys hadde belast te vertrecken, sonder dat hij eenige ander oorsaeck tot zulcx als vooren hadde gehadt, ende dede overzulcx d’voorseyde Mariaes deur zijn goede mannen presenteren ten behouve van de requirant dertich stuvers voor zijn pijn smert ende versuym ende dat hij boven dien ‘t meesterloon soude betaelen, dan wilde niet hoger comen, daer mede de requirant niet te vreden zijnde bleeff het treffen van ‘t accordt tusschen partijen voornoemt achterwech ende scheyden mitsdien zijluyden ten voorseyde tijde van de anderen sonder partyen te vereenigen, gevende zij deposanten voor redenen van wetenschap van ‘t gunt werden, ten voorseyde dage wes voorseyde staet gehoort ende gesien te hebben ende op ‘t passeren vandien aen ende overgeweest te zijn. Wijders niet verclaerende, presenterende zij deposanten ‘t gunt voorseyd staet des noot ende versocht zijnde naerder mit solempnelen eede te bevestigen, ende versocht den requirant hier van bij mij notario acte in forma geexpedieert ende hem gelevert te werden. Aldus gedaen verleden ende gepasseert ten dage maent ende jaere voorseyd ten comptoire mijns notaris ter presentie van Cornelis Cuylman ende Dirck van Hallmael schrijver innewoonders deser stede als getuygen gelooffwaerdich hiertoe beneffens mij notario geteykent.
