We, Pieter Arentsz Deyman and Amelis van Hogeveen, aldermen in Leiden, certify that Seigneur Johan de Lalaing appeared before us. He declared for himself and his heirs that he had sold, and by this deed did sell, to Jan Robinsz, minister of the Divine Word to the English congregation in this city, Willem Jepzon, Henry Woed and Raynulph Thickins, married to Jane White, jointly and each for one lawful quarter share, a house and yard with a yard lying to its west, standing within this city on the south side of the Pieterskerkhof near the Clockhuys, long known as De Groene Poort.

On the eastern side it adjoins, first, the appearing seller himself, with a small room which he retains above the gate of the house sold; then Willem Symonsz van der Wilde; and then the buildings of the Commandery. On the western side it adjoins, first, the widow and heirs of Huych van Alckemade; then the appearing seller himself; then the Donkere Gracht, lying west of the aforesaid side yard; and then the Faliede Begijnhof. It extends from the street of the aforesaid churchyard at the front to the Faliede Begijnhof at the rear.

The sale comprises the house as it is now built, arranged, used and inhabited, together with everything in it and everything fixed to the ground or nailed in place belonging to the seller, subject to an annual ground rent of eleven stuivers and twelve penningen, with feudal dues, belonging to the lord of Poelgeest. The seller promised to indemnify and warrant the house and yard, subject to that charge and those conditions, against every further burden or encumbrance by which it might in any way be affected, for a year and a day and thereafter in perpetuity as the law requires, under a general pledge of all his movable and immovable goods, present and future, none excepted.

The seller further acknowledged that, on account of the sale, he had been fully satisfied and paid from first penny to last by means of a mortgage deed for 8,000 guilders of forty groten each. Of that sum, 2,000 guilders was paid in cash; the remainder was to be paid at 500 guilders a year, the first instalment falling due on May Day 1612. All this was done in good faith and without fraud.

In witness, this deed was confirmed with our seals on 5 May 1611. Beneath was signed: J. van Swanenburch; sealed, etc.

The appearing buyers, each standing surety for the others and as principal debtors, renounced the legal benefits of division and prior execution, whose force and effect they declared they fully understood. On account of the purchase, in addition to the annual ground rent of eleven stuivers and twelve penningen with feudal dues left upon the house and yard, they acknowledged that they owed Johan de Lalaing 8,000 guilders of forty groten each.

They promised to pay 2,000 guilders in cash on May Day 1611, when they took possession of the house and yard, and thereafter 500 guilders on each May Day, beginning in 1612, from year to year until the full 8,000 guilders had been paid.

In place of an oath, they promised on their honour and good faith to pay all those sums free of deductions for levies, subsidies, assessments, property taxes or any other contributions, whether of the hundredth, fiftieth, twentieth or tenth penny, or any greater or lesser charge, whatever it might be called and whoever might impose it, whether already introduced or imposed later. Even if an ordinance or other rule should declare that a deduction might or must be made from such purchase money, they expressly renounced every benefit arising from it.

They specially pledged the house and yard, and generally all their other respective movable and immovable goods, present and future, none excepted. They also promised to indemnify one another for their respective quarter shares in the aforesaid suretyship, under the same pledge. All this was done in good faith and without fraud.

In witness, this deed was confirmed with our seals on 5 May 1611. It was signed J. Swanenburch and sealed with two green wax seals hanging from double parchment tags.

Henrick Woed, an Englishman and inhabitant of this city, appeared before the undersigned aldermen of Leiden. By this deed he appointed and fully authorised Henrick Jepzon, likewise an Englishman, especially to sell and convert into money, either publicly or privately, to such person, for such sum and price, in such manner of payment and upon such conditions as the authorised representative should think fit, a certain quarter share of a house and yard standing within this city on the south side of Saint Peter’s Churchyard near the Clockhuys, long known as De Groene Poort.

The other three quarter shares belonged to Jan Robbintsz, minister of the Divine Word to the English congregation in this city, Willem Jepzon and Reynulph Thickins. The property had formerly been sold and conveyed to them by Seigneur Johan de Laleing.

The authorised representative was empowered to convey and transfer the purchased share to the buyer in the proper place and manner, with a promise of warranty and indemnity against every later claim, and to pledge the appearing principal’s goods for that purpose. He was further empowered to have the buyer execute a mortgage deed, to receive and collect the purchase money, and to issue a receipt for it or have the payment endorsed upon the mortgage deed.

If necessary, he might bring and conduct legal proceedings concerning the payment against any person, observe all legal terms, apply for judgments and hear them pronounced, accept them and have them executed, or appeal from them by appeal, reformation or otherwise, as the circumstances required and good counsel advised, and pursue any appeal to its final conclusion.

Generally, in all the foregoing matters, he might do everything that the appearing principal could have done if personally present everywhere, even if a more particular or special authority than that stated above should be required. He was also empowered to substitute one or more persons for litigation only and, if he thought fit, to revoke them.

The appearing principal promised to hold valid and to perform everything done and transacted in the foregoing matters by his authorised representative or any substitute, under such pledge as the law requires. The representative remained obliged, upon demand by the principal, to render and deliver a proper account, proof and balance of his receipts and actions.
