On 2 March 1612 Laurys van Dale, mason, transfers to William Bradford, Englishman, a newly-built house and ground on the north side of the Achtergracht running along Marendorp between the Paradijssteeg and the Bouwenlouwensteeg in Leiden. 1 scan Open recordClose record

We, Andries Jaspersz van Vesanevelt and Master Clemens van Baersdorp, aldermen of Leiden, certify that William Bradford, Englishman, appeared before us and declared that he had bought from Laurys van Dale, mason, a newly built house and yard in this city on the north side of the Achtergracht behind Marendorp, between the Paradijssteeg and Bouwenlouwensteeg. It was bounded on the east by Frans Joostensz, tawer, on the west by the seller himself, and extended from the Achtergracht to the property of Frans Joostensz.

Besides an annual ground rent of seven stuivers, with or without holding charge, left for Bradford to pay, he acknowledged owing Laurys van Dale 2,100 guilders of forty groten each. Bradford and Roger Wilson, an English baker who appeared as surety and principal debtor after waiving the legal benefits of order and execution, promised to pay 600 guilders on 1 May 1612 and thereafter 150 guilders each year, beginning on 1 May 1613, until the remaining 1,500 guilders had been paid in full.

They promised on their honour, in place of an oath, to make every payment in full without deduction for taxes, assessments or contributions, present or future, and expressly waived any benefit of measures allowing such deductions. Bradford specially pledged the house and yard; both men generally pledged all their present and future movable and immovable goods. Bradford promised to release Roger Wilson from the suretyship and keep him free from loss.

Done in good faith and confirmed with our seals on 2 March 1612. Signed J. Swanenburch and sealed. In the margin: this deed was cancelled at the secretary's office after William Bradford showed that it had been paid; the registration was therefore struck through on 1 April 1620.

Further subject to such conditions, terms and warranty as are contained in the old title deeds relating thereto, which he, the appearing party, hereby transferred and delivered to the buyer, with all the right and claim pertaining thereto. The appearing party further promised, subject to and under the aforesaid encumbrances and conditions, to warrant and defend the aforesaid house and grounds against any further claims or charges that might have been imposed upon it by him during the time of his ownership, binding thereto generally all his goods, movable and immovable, present and future, none excepted.

Furthermore, the appearing party acknowledged that he had been fully and completely satisfied and paid for the aforesaid sale, the last penny with the first, by means of a bond, containing, over and above the promise of indemnity for the aforesaid encumbrances, a sum of ninety-five guilders of the aforesaid currency, to be paid likewise in free money, fifty of the aforesaid guilders in cash, and the remaining forty-five guilders on May Day of the year 1621; and all this in good faith and without deceit.

Before me, Jacob Jansz Verwey, notary public admitted by the Court of Holland and residing in Leiden, and the witnesses named below, appeared Roger Wilson, serge worker living in Leiden. Though ill in bed, he appeared to be in full possession of his reason, memory and understanding.

He declared that Henry Wood and William Jepson, also of Leiden, had stood surety for the purchase price of his house and yard on the Uiterstegracht. About nine hundred Carolus guilders remained due, payable at one hundred guilders a year beginning in May 1614, besides an annual ground rent of six guilders and five stuivers, redeemable for one hundred guilders.

Not wishing his guarantors to suffer loss, Wilson directed that immediately after his death they should enter his estate, sell and convey the house and all his other goods, collect the purchase money and outstanding debts, pay the remaining nine hundred guilders and his funeral and other debts, and divide what remained equally: one half to his heirs living in Sandwich, England, and the other half to the English congregation in Leiden, of which he was a member.

He declared this to be his last will and wished it to take effect as a codicil or gift in contemplation of death. Done at Wilson's bedside on the Uiterstegracht on 16 September 1613 at about ten in the morning, in the presence of William Brewster, elder of the congregation, and James Hurst, wool comber, as witnesses.

We, Willem Cornelisz. Tybault and Jacob Paets Cornelisz., aldermen of Leiden, make known that before us came and appeared Rogier Wiltson, Englishman, who acknowledged, for himself and his heirs, to have sold, and accordingly transferred hereby unto and for the benefit of Ridtsart Meesterson, likewise Englishman, a house and grounds, standing and situated within this city on the west side of the Uiterstegracht, bordering on the one side, to the north, on the property of Marijtgen Pietersdr., widow of Michiel Pietersz., in front with a common dividing wall, and at the back, so far as the rear building of this sold house extends, with a free wall of its own belonging to this sold property. But inasmuch as this wall stands on ground held in common by this sold house and by the aforesaid Marijtgen Pietersdr., she shall also be entitled to make use of the same wall at all times, provided she first pays and compensates the possessor of this sold house for half thereof. And on the other side, to the south, on the property of Pieter Henricxz., bargeman, likewise with a common dividing wall and a common wooden fence, running in front from the street of the aforesaid Uiterstegracht to the back, together with the aforesaid summer-house, as far as the children and heirs of Lambrecht Jacobsz., in his lifetime a vegetable-grower.

All this as the aforesaid house presently stands built and constructed, and is used and inhabited, subject to the charge of an annual ground-rent of six guilders of 40 groats each and five stivers, free money, per year, due to the aforesaid children and heirs of Lambrecht Jacobsz., which rent, to the charge of him the appearing party, has already begun to run from May Day of this past year sixteen hundred and fourteen, with the commencement of the aforesaid house and grounds, and otherwise free without any further charges. However, the buyer shall have to tolerate upon the aforesaid house and grounds the special mortgage of such purchase-money instalments as he the appearing party still owes from the previous purchase thereof, which he the appearing party retains at his own charge to satisfy himself, and he promised to indemnify and hold the buyer harmless thereof as is proper. And further with such conditions, terms, and warranties as are contained in the old title-deeds, upon which this present deed is transfixed and pierced through, which he the appearing party hereby delivered over to the buyer with all the right and title thereof.

He the appearing party also promised, besides, and thus with and under the aforesaid charges and conditions, to warrant and free the aforesaid house and grounds from all further encumbrance and burden with which the same might be charged or burdened by him during the time of his ownership, under general obligation of all his goods, movable and immovable, present and future, rights and debts receivable, none excepted.

Furthermore he the appearing party acknowledged himself, on account of the aforesaid sale and transfer, to be fully and entirely satisfied, paid, and content, the last penny with the first; and this by means of a bond of purchase-money, comprising, over and above the aforesaid rent charge, a sum of eight hundred guilders of 40 groats each, free money, payable with one hundred of the said guilders in cash, which fell due already on May Day of the year sixteen hundred and fourteen past, and further with a like one hundred guilders per year, the first falling due on May Day of the year sixteen hundred and fifteen.

And all this in good faith and without deceit or guile. In witness whereof this is confirmed with our seals, on the second of January of the year sixteen hundred and fifteen. Below was written: J. Swanenburch. Sealed, etc.

We, Willem Corneliszoon Tijbault and Jacob Paets Corneliszoon, aldermen of Leiden, make known that before us came and appeared Ridtsardt Meertersson, Englishman, declaring that he had bought from Rogier Wiltzon, likewise an Englishman, a house and ground standing and situated within this city on the west side of the Uiterstegracht, bounded on the one side, to the north, by Marytge Pietersdochter, widow of Michiel Pieterszoon, and on the other side, to the south, by Pieter Henricxszoon, skipper, extending in front from the street of the aforesaid Uiterstegracht to the rear onto the property of the children and heirs of Lambrecht Jacobszoon, greengrocer.

And the appearer acknowledged that he had taken upon himself, charged upon the aforesaid house and ground, and hereby takes upon himself, a redeemable ground-rent of six guilders at forty groats each and five stuivers, in free money, per year, owed to the aforesaid children and heirs of Lambrecht Jacobszoon, which rent has begun to run to the charge of the appearer since May-day of the year sixteen hundred fourteen last past; of which rent and its principal sum the appearer accordingly promised, as is fitting, to indemnify the aforesaid Rogier Wiltson and to hold him free of cost and harm.

Moreover, the appearer acknowledged that, by reason of the same purchase, he owed the aforesaid Rogier Wiltson a sum of eight hundred guilders of the aforesaid currency, which he promised to pay in this manner: one hundred of the aforesaid guilders in cash, already due and settled at May-day sixteen hundred fourteen last past, together with the taking possession of the aforesaid house and ground; likewise at May-day sixteen hundred fifteen, another hundred guilders; and thereafter yearly, at each following May-day, likewise a hundred guilders, continuing thus from year to year until full payment of the aforesaid eight hundred guilders.

The appearer further promised, upon his honour and integrity in place of an oath, to pay all the aforesaid monies in free money, without any deduction or reduction, whether for aids, subventions, land-tax assessments, or other contributions of the hundredth, fiftieth, twentieth, or tenth penny, more or less, however these might be named, and by whomever they have already been imposed and levied or shall be imposed and levied; and even should it be declared by placard or otherwise that a reduction or discount must be allowed on these and similar purchase monies, the appearer expressly renounced and waived all benefit and advantage thereof by these presents.

There further came before us, the aforesaid aldermen, Jan Meesterson, wool comber, and set himself hereby as surety and also as principal for the aforesaid Ridtsardt Meeterson, his brother, both concerning the indemnification of the aforesaid rent and its principal sum, and concerning the free payment of the aforesaid eight hundred guilders; binding hereunder, first, the aforesaid Ridtsardt specially the aforesaid house and ground, and further both appearers generally all their respective goods, movable and immovable, present and future, none excepted. The aforesaid Ridtsardt promised to relieve his aforesaid brother, in this matter, of the aforesaid suretyship, and to hold him free of cost and harm, under the same obligation as above.

In witness whereof this is confirmed with our seals, on the second of January of the year sixteen hundred fifteen. Underneath: J. Swanenburch, sealed, etc.

There appeared before the undersigned aldermen of the city of Leiden, Jan Ellis, wool comber, aged about 50 years, and Rogier Wilson, camlet weaver, aged about 34 years, both living within this city.

And they declared and affirmed, having been lawfully sworn and examined under solemn oath, at the request and instance of Ridtsart Mestersz., likewise a wool comber, that it was true that they, the appearers, have had good acquaintance with the aforesaid petitioner for about seven years past, and that during that same time they have maintained good conversation and friendship with the said petitioner within this city, such that they, the appearers, know that the petitioner has, in all his trade and conduct towards them and likewise towards everyone else during the aforesaid seven years, conducted himself honestly and virtuously, as befits and becomes a virtuous young man, without ever, to the appearers' knowledge, his having been rumoured or reputed to have committed any evil deeds, still less to have been apprehended for such. Declaring nothing further.

So truly may Almighty God help them both. Done the 20th of March, sixteen hundred and nineteen. H.P. Codijck, G. van Lanschott.

Marginal note: Note that a duplicate of this deed has been issued in the Latin language, the translation of which is attached to the copy of the minutes of the depositions.
