Consent to arrest.

On the 20th of July 1616, the sheriff and aldermen of this city, upon the written request made by or on behalf of Eduwaert Butcher and Jan Sissel, both merchants in England, have hereupon authorised the first officer with the rod, as requested herein, to place and take into arrest the persons of Johan and Willem Crips within this city and its freedom, in order to recover thereby, respectively, their outstanding debts by virtue of the bonds concerning the same, but all this at the risk of the aforesaid petitioners.

Consent van arrest Op ten XXen july 1616 ende hebben schout ende schepenen deser stede op ‘t schriftelick versouck gedaen bij off van wegen Eduwaert Butcher, ende Jan Sissel beyde coopluyden in Engelant den Ien bode mitte roede hier op versocht geauthoriseert omme de personen van Johan ende Willem Crips binnen deser stede ende de vrijdomme vandien in arreste te stellen ende nemen om haerluyder achter wesen respective daer om te verhalen vermogens de obligatien daer van zijnde, doch alles ten pericule van de voorseyde supplianten. Actum ut supra.

Heemskerc, authorized representative of Willem Crips, plaintiff, against Thomas Hauwaert, defendant, for restitution of two gold Jacobus coins, and further of a half and two quarters of a Jacobus, together with four English shillings, which the aforesaid Willem Crips had, in good faith, placed in the hands of the aforesaid Hauwaert, alongside three gold rings and some other payment. He therefore concludes for condemnation thereof, with costs.

In the margin: Sentence Book T, folio 149 verso. De Goede, on behalf of the aforesaid defendant, first and foremost protests against atrocious insults [i.e. objects to the offensive language used], and states that he has restored to the plaintiff the purse with the rings in the same condition in which the plaintiff had handed it to him; he therefore concludes that the claim be dismissed, with costs.

Heemskerck, replying, persists in his claim and requests as above. Done 12 August 1616.

The aldermen order the parties to appear before them again in person on the Wednesday eight days hence. Done 15 August 1616.

De Goede persists, in rejoinder, in the conclusions in law and the requests aforesaid.

The aldermen, having heard the parties and examined what was produced, having weighed everything that might move them, doing justice, rule that — provided the defendant purges himself by oath that he did indeed restore to the plaintiff his purse just as it had been handed to him by the plaintiff, without having changed anything therein — they dismiss the plaintiff's claim and the conclusion made and taken thereupon against the defendant, and nevertheless offset the costs between the parties for reasons moving them thereto. Done 24 August 1616.

The defendant has taken the oath in conformity with the foregoing judgment. Done 31 August 1616.

Heemskerc gemachtigt van Willem Crips, eyscher contra Thomas Hauwaert gedaechde om restitutie te hebben van twee goude Jacobusstucken, noch van een halve twee vierendelen van een Jacobus, mitsgaders vier Engelsche schellingen bij den voornoemde Willem Crips den voorseyde Hauwaert ter goeder trouwen neffens drie goude ringen ende eenich ander paeyment ter handen gestelt concludeert daeromme tot condemnatie vandien mitte costen In de marge: VonnisBoek T folio CXLIX verso De goede van wegen de gedaechde voornoemt protesteert eerst ende alvoren van atroce injurien ende seyt de beurs mette ringen soo d’eyscher hem die behantreyct hadde in der selver vougen aen hem gerestitueert te hebben, concludeert oversulcx tot ontsegginge van den eysch ende conclusie mette costen. Heemskerck replicerende persisteert ende versouct boven actum 12-8-1616. Schepenen ordonneren partijen tegens woonsdach toecomen over acht dagen boven te compareren in persoon.
